SHIPPING

Shipping rates and eligibility for free shipping are displayed at checkout.

Free shipping, when offered, applies only to qualifying orders within the continental United States unless otherwise stated.

Orders cannot be modified or canceled once shipped.

Our paddles and equipment are designed for athletic use. Use at your own risk. Discontinue use if discomfort occurs and consult a medical professional if necessary.

INDEMNIFICATION

You agree to indemnify and hold harmless SENS Pickleball Inc. and its affiliates from any claims arising from your use of the site or violation of these Terms.

DISPUTE RESOLUTION & ARBITRATION

Any dispute, claim, or controversy arising out of or relating to these Terms, your use of the site, or any products or services purchased from SENS Pickleball Inc. shall be resolved through binding, individual arbitration, rather than in court, except as set forth below.

Arbitration shall be administered by the American Arbitration Association (AAA) in accordance with its applicable rules. The arbitration shall take place in Los Angeles County, California.

You agree that:

  • Disputes will be resolved on an individual basis only, and not as part of any class, consolidated, or representative action
  • You waive any right to a jury trial
  • The arbitrator shall have authority to award relief only on an individual basis

Notwithstanding the foregoing, SENS Pickleball Inc. may seek injunctive or equitable relief in any court of competent jurisdiction to protect its intellectual property or confidential information.

GOVERNING LAW

These Terms are governed by and construed in accordance with the laws of the State of Delaware, without regard to conflict of law principles.

Subject to the arbitration provisions above, any legal action or proceeding shall be brought exclusively in the state or federal courts located in Los Angeles County, California, and you consent to the jurisdiction of such courts.
